Subaru of America has settled its cracked windshield lawsuit for the owners of 1.4 million vehicles. According to Top Class Actions, Subaru of America agreed to settle the lawsuit with the owners of the 2019-2022 Forester, 2019-2022 Ascent vehicles, 2020-2022 Outback, and 2020-2022 Legacy vehicles.
Before I give you the proposed settlement details, here is information on the history of the Subaru cracked windshield lawsuit. I started covering the lawsuit more than four years ago. Several lawsuits were consolidated into one class action lawsuit.
According to the lawsuit, "defects cause minor chips in the glass to spread across the windshield." Subaru argued that the windshields met all federal safety regulations. While the plaintiffs complained that dealerships wouldn't cover the cost of windshield repairs under warranty, Subaru argued that the warranty didn't cover such damage.
The class action lawsuit also alleged Subaru knew about the windshield problems because dealers were issued technical service bulletin (TSB) 12-192-15R.
According to the plaintiffs, replacing the windshield is useless because Subaru uses the same defective windshields as replacements. In addition, the class action lawsuit alleged that repairing or replacing the windshield affects Subaru's EyeSight driver asset safety technology. Recalibrating the safety system is an additional cost.
New data from the IIHS says it will cost more than you think to replace your new model Subaru windshield. Check out the report here https://t.co/l2uvIyhzJu #subaru #eyesight @torquenewsauto pic.twitter.com/ljfUzixuZT

Drivers whose vehicles are included in the windshield defect class action chose their vehicle because it offered the EyeSight safety feature. "So having the technology rendered useless by the windshield defect poses financial injury to drivers."
Four Years Of Litigation
After four years of litigation, 13 depositions, tens of thousands of pages of discovery documents, subpoenas, and more involving a projected class of owners, former owners, and lessees are getting windshield replacements and refunds under the proposed settlement.
There were originally 16 named plaintiffs in the Subaru lawsuit, but only four were involved by settlement time. Subaru of America denies all wrongdoing and denies the windshields are defective. A report from CarComplaints says, "The automaker says it decided to settle the lawsuit to end the expensive and time-consuming litigation."
Here is What Subaru Of America Agreed To:
1. Subaru agreed to an extended warranty of eight years or 100,000 miles and a one-time windshield replacement as part of a class action settlement submitted for preliminary approval in the U.S. District Court for the District of New Jersey.
2. The agreement says, "The Subaru cracked windshield extended warranty is limited to a one-time replacement of the windshield. Once replacement occurs, this will end the extended warranty as it expires once the windshield has been replaced."
There is a new ruling in the Subaru defective windshield lawsuit. See what it means for new Forester, Outback, Crosstrek, Impreza, Legacy, and Ascent owners. https://t.co/iFDNqGSCRL #subaru #subaruwindshieldlawsuit @torquenewsauto pic.twitter.com/UdOsshn3HG
— Subaru Report (@SubaruReport) January 2, 2021
3. The settlement also calls for reimbursement of documented prior windshield replacements with proof of a qualifying windshield crack. Subaru customers will only be reimbursed if damage was caused by residual windshield stress, not any other cause.
4. The cracked windshield settlement says there is a process Forester, Outback, Ascent, and Legacy owners must go through to "prove that their loss was caused by the alleged defect as opposed to impact damage that would have caused a cracked windshield regardless of any alleged defect."
Subaru Has A New Process For Manufacturing The Defective Windshields
5. The settlement agreement says, "The new windshield will be manufactured with a revised process that substantially reduces the likelihood of a crack/damage occurring to a windshield from a minor impact and residual stress."
What Should Customers Do?
Subaru Forester, Outback, Ascent, or Legacy must know that though the parties have agreed to settle the cracked windshield class action lawsuit, a federal judge must still grant preliminary and final approval to the terms before anything is official. Stay tuned to my reports for more updates on the Subaru defective windshield lawsuit.

So what happens when I have the same issue on my 2024? Came across this article trying to find info on why my 2024 Outback has an unexplained crack starting in the black portion at the bottom. When I went to get an estimate for replacement, the guy was really weird about it and said he would need to check since they changed the windshield in 2024.

My wife owns a 2022 Subaru Outback with around 34000 kms.
On an Xmas trip we got a small stone chip on the far edge of the passenger side.
Yesterday we noticed a crack, which is now around a foot in length, has developed. This is six days after the trip.
We live in Canada and received the extended warranty notice. Are we covered?

I have replaced like 5-6 windshields on my 2018 subaru outback. The first one was the day after I bought it new. Went to go to work and car parked in garage had cracked windshield. Dealer did replace that for free and said "perhaps the cold"-- was in Iowa. Then went a couple years everything fine and had a small rock hit and spread to whole thing quickly and I got it replaced. Then a series of new windshields would only last like 1-2 months and it was cracked again. Typically $1300-1400 each time. I had 3 in one year. Finally just left a "not bad crack" because it was obvious to me (although not to dealer service folks) that something was wrong in windshield manufacturing or installation, but is was NOT how I was driving. Owned lots of cars and never anything like that with other cars. So I have spent many thousands on windshields and no apparent remedy other than leave it cracked.

Something put a pit in my windshield and there are tiny specks which are pits as a result.
What’s worse is that the protective coating applied to their windshields is decaying after 2 years making it extraordinarily difficult to see out of the windshield at night when it rains hard due to oncoming headlights.

The windshield of my 2019 Forester spontaneously cracked when I was on the highway last year. To my knowledge, nothing even hit the windshield, it just cracked. I took it to the Subaru dealership in my area about 6 months ago to have it inspected and possibly replaced. The cost of replacement was astronomical for a windshield. The tech told me that he sees broken windshields every day and that the glass is likely defective. I have never replaced the glass, which is a safety issue I acknowledge, waiting for Subaru to potentially issue a recall.

I purchased a 2024 Subaru Outback in July 2024, and with less than 3,000 miles, I noticed an unexplained crack in the windshield one morning. The crack originated from the bottom with no visible impact and quickly spread. Within a week, another crack appeared in an entirely different location, again with no sign of impact.
When I initially brought this to Subaru’s attention, I was told it was due to a small chip from impact. However, I strongly disagree, as there was no such impact. Since that visit, five additional cracks have formed, all originating from the bottom of the windshield, and none show any signs of external damage.
Given the increasing number of cracks and their nature, I am bringing my vehicle back to Subaru to request a good faith effort to resolve this issue appropriately. If Subaru is unable or unwilling to address this as a potential defect, I will need to explore the next steps to ensure a fair resolution.
After having seven Subarus in the last 20 years, I have never had a windshield issue.

I have a 2021 Forester. My windshield has cracked twice. There was no impact to the windshield either time. The first time I was sitting in the car, eating my lunch, and saw it just appear out of nowhere from the very bottom of the glass in the middle. Got that one replaced with the extra warranty I had bought. The second time I was on the highway when it just appeared from the very bottom again. What is going on?? very frustrating Subaru!!

I just had my windshield replaced on my 2016 Outback. I had a crack that extended 30 inches across the drivers side starting from a small impact chip point 3 inches from the lower left corner (viewed from inside driver's seat). I was surprised the small chip point cracked instead of the usual 1 inch starburst.

Thank you. Very interesting!
It seemes that the issue still exists because I bought my new 2024 Crosstrek in British-Columbia in September 2024 and guess what?
A nice windshield crack going left to right just above the hood appeared with no noticable hit in March 2025.
I am in Washington State today, July 2025 and to my biggest surprise I saw an identical Crosstrek, same year as mine, with an extremely similar crack at the exact same heigth.
Are you aware of a new lawsuit? Because, after reading your article and witnessing abnormal cracks I start to think Subaru did not fix their windshelds since 2022.

Yesterday I took my 2022 Subaru Outback in for an oil change & tire rotation. During my wait, I was contacted by a rep from Safelite Auto glass who just happened to be on the dealership premises, that an inspection of the vehicle's front windshield revealed several small nicks and chips almost too small to visibly observe; however what did stand out was the top perimeter of the entire windshield displayed what appeared to be a crack separation along its entire perimeter. The glass rep advised that this separation was only going to get worse over time and counseled me to file an insurance claim for the windshield replacement based on this discovery. Once the rep pointed this out to me, it was quite noticeable and disturbing. I am having the windshield replaced under my insurance coverage (all costs covered), but my question is: should I file a claim with Subaru to have these costs reimbursed? Tks, George Tatum III [email protected].
